By accessing or using the Ailurn platform and related services (the "Service") operated by Ailurn, Inc. ("Ailurn," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. We may update these Terms from time to time; continued use after changes constitutes acceptance.

2. Description of the Service

Ailurn provides an AI-powered platform that helps you create personalized courses and lessons based on your learning goals. The Service includes conversational course creation, course and lesson content, and related features as described on our website. We reserve the right to modify, suspend, or discontinue any part of the Service at any time.

3. Account and Registration

You must create an account to use certain features of the Service. You agree to provide accurate and complete information and to keep your account credentials secure. You are responsible for all activity under your account. You must be at least 13 years old (or the minimum age in your jurisdiction) to use the Service.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not: (a) use the Service in any way that violates applicable laws or regulations; (b) attempt to gain unauthorized access to the Service or other users' accounts; (c) use the Service to generate harmful, misleading, or illegal content; (d) interfere with or disrupt the Service or infrastructure; (e) scrape, copy, or resell the Service without our permission; or (f) use the Service to harass, abuse, or harm others. We may suspend or terminate your access for violation of these terms.

5. Intellectual Property and Your Content

Ailurn and its licensors own all rights in the Service (including software, design, and branding). You retain ownership of content you submit (e.g., prompts, messages, and any materials you upload). By using the Service, you grant us a limited license to use, store, and process your content as necessary to provide and improve the Service, in accordance with our Privacy Policy. AI-generated course and lesson content is provided for your personal learning use; rights to such content are as set out in your plan and applicable law.

6. Payment and Billing

Paid plans are billed in accordance with the pricing and billing cycle you select. Fees are non-refundable except as required by law or as stated in our refund policy. We may change pricing with reasonable notice. You are responsible for any taxes applicable to your use of the Service.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. AI-GENERATED CONTENT MAY CONTAIN INACCURACIES OR ERRORS; YOU ARE RESPONSIBLE FOR VERIFYING INFORMATION BEFORE RELYING ON IT. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AILURN AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN SUCH CASES, OUR LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

9. Indemnification

You agree to indemnify and hold harmless Ailurn and its affiliates, officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Service, your content, or your violation of these Terms or any applicable law.

10. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access to the Service, with or without notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service ceases. Provisions that by their nature should survive (including disclaimers, limitation of liability, and indemnification) will survive termination.

11. Governing Law and Disputes

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict of law principles. Any dispute arising from these Terms or the Service shall be resolved in the courts located in Delaware, and you consent to personal jurisdiction there. Nothing in these Terms limits your right to seek relief in any applicable jurisdiction for consumer protection or data protection matters.

12. General

These Terms, together with our Privacy Policy and any other policies we publish, constitute the entire agreement between you and Ailurn regarding the Service. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any right does not waive that right.
